For the purposes of these Conditions, it is understood that the activity that Alaitz Larizgoitia (hereinafter Alaitz.art) develops through the Website includes: the sale and marketing of art and stationery products, as well as the sale and management of reservations for her courses, events or workshops.

In addition to reading these Conditions, the User agrees to have read the Legal Notice, the Cookies Policy, and the Privacy and Data Protection Policy of Alaitz.art. By using this Website or by making and/or requesting the purchase of a product through it, the User agrees to be bound by these Conditions and by all the aforementioned, therefore, if you do not agree with all of this, do not use this Website.

Likewise, we inform that these Conditions could be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, since those in force at the time of the purchase of products will be applicable.

The User can make inquiries in relation to the Conditions through the contact information provided or using the contact form from the website itself.

2. USER

The access, navigation, and use of the Website, confers the condition of User (hereinafter referred to, indistinctly, individually as User or jointly as Users), for which reason they are accepted, from the moment the navigation on the Website begins, all Conditions established here, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory compliance as the case may be.

The User assumes his responsibility for the correct use of the Website. The User declares to be over 18 years of age and have the legal capacity to enter contracts through this Website.

3. PURCHASE PROCESS

The User can make purchases on the Website by the means and forms established through the online store and workshops. To do this, you must follow the established purchase procedure during which you can add as many products and/or services to the basket as you consider. The User must truthfully fill in and/or verify the information that is requested at each step, to carry out the purchase. Subsequently, the User will receive an email confirming that their order or request for purchase and/or provision of the service has been received, thus being considered as confirmation of the order placed. The User acknowledges at the time of purchase that he is aware of and accepts the particular conditions of the product and/or service in question: name, weight, manner in which it will be carried out,etc.

4. AVAILABILITY

All purchase orders received by Alaitz.art through the Website are subject to the availability of the products and/or services. If there are difficulties regarding their supply, Alaitz.art will contact the User and reimburse any amount that may have been paid as an amount for said product and/or service, or proceed to any change if agreed by both parties.

WARNING: the products made by Alaitz Larizgoitia, Alaitz.art, are elaborated in an artisan way and with natural elements, it is for this reason that they may undergo changes both in colour, as well as in shape and appearance, but always ensuring the quality levels of Alaitz.art products.

5. PRICES AND METHOD OF PAYMENT

The prices displayed on the website are the final ones, in euros and include the corresponding taxes. The prices can change at any time, but the possible changes will not affect the orders or purchases with respect to those that the user has already received.

The accepted means of payment are Credit and debit cards. PayPal as indicated during the purchase process. Once your payment has been verified, we will start managing, processing, and shipping your order.

6. DELIVERY

In the cases the physical delivery of the contracted good is suitable, the deliveries will be made only in the area of Mallorca and for this the User is required to contact us at info@alaitz.art to place the order. For the purposes of these conditions, delivery will be considered to have occurred at the time the user or a third party indicated by the user acquires material possession of the products, which will be accredited by signing the receipt of the order at the agreed delivery address. Delivery times may be variable depending on the production times of our artisan products and the availability in stock.

7. RETURNS

If it is a good with a physical support, the User has a period of 7 calendar days to withdraw from the purchase made on the Website. The term will compute from the delivery of the same. In the event of being an online product and/or service, changes and/or returns will not be accepted. To exercise this right of withdrawal, as referenced, and when it proceeds, the User must notify his decision with a clear statement to Alaitz.art, within the period established for this purpose and by email: info@alaitz.art. The refund to the User will be through the same payment method used by the User at the time of making the initial purchase transaction. No refund will be made if the product has been used, is not in the same condition in which it was delivered or has suffered any damage after delivery.

In case of return, the user will manage the return of the same by the same way that it was delivered and will bear the shipping costs derived from said return.

8. EXEMPTION OF LIABILITY

Unless otherwise provided by law, Alaitz.art will not accept any responsibility for: Lack of availability of the website for maintenance or other reasons, which prevents the availability of the service; any breach or delay in the fulfillment of any of the obligations assumed, when it occurs as consequences that are beyond its reasonable control, that is, that are justified by force majeure.

10. INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents of the website www.alaitz.art, including the images and texts of the articles, regardless of their format, programming language and form of representation, are the property of Alaitz Larizgoitia, or it has acquired the corresponding rights from its owners, and are protected by international intellectual property laws and treaties.

By virtue of the provisions of the Intellectual Property Law, it is expressly prohibited to copy, reproduce, sell, transmit, distribute, republish, modify, or display for commercial use without the prior consent of Alaitz Larizgoitia. The User accepts to respect the Intellectual and Industrial Property rights owned by Alaitz Larizgoitia.

11. ENTIRE AGREEMENT

These conditions and the entire document to which they refer constitute the entire agreement between the user and Alaitz Larizgoitia in relation to the object of sale and replace any other agreement, or previous agreement agreed either verbally or in writing between the same parts.

12. MODIFICATION OF THE PRESENT CONDITIONS AND DURATION

Alaitz Larizgoitia may modify the Conditions determined here at any time, being duly published. The validity of the aforementioned conditions will depend on their exposure and will be in force until they are modified by others duly published.

13. APPLICABLE LAW AND JURISDICTION

The relationship between Alaitz.art (Alaitz Larizgoitia) and the User will be governed by current Spanish regulations and any controversy will be submitted to the Courts and Tribunals of the city of Palma de Mallorca.
